General Terms and Conditions (AGB)
1) Scope of Application
1.1 These General Terms and Conditions (hereinafter “GTC”) apply to all contracts concluded between Gigi Room Ceramics, operated by Gizem Sirmali (hereinafter “Seller”), and consumers or traders (hereinafter “Client”) via the Seller’s online shop.
1.2 These GTC apply to the sale of:
physical goods (ceramic products),
gift cards,
tickets for events organized by the Seller.
1.3 Any deviating terms and conditions of the Client shall not apply unless expressly agreed in writing.
1.4 A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor self-employed.
1.5 A trader is a natural or legal person or a legally capable partnership acting in the exercise of a commercial or self-employed activity.
2) Conclusion of the Contract
2.1 Product descriptions in the Seller’s online shop do not constitute binding offers but serve to submit a binding offer by the Client.
2.2 The Client submits a binding offer by completing the online order process and clicking the button concluding the order.
2.3 The contract is concluded when the Seller confirms the order by email or delivers the goods or digital content.
2.4 Order processing and communication usually take place via email. The Client must ensure that the provided email address is correct and reachable.
2.5 The contract language is English.
3) Right of Withdrawal
3.1 Consumers generally have a statutory right of withdrawal.
3.2 Details on the right of withdrawal are provided in the separate Withdrawal Policy (Widerrufsbelehrung).
3.3 The right of withdrawal does not apply to:
custom-made or personalized goods,
tickets for events with a fixed date or period,
services related to leisure activities with a fixed date,
in accordance with § 312g (2) BGB.
4) Prices and Payment Conditions
4.1 All prices stated are final prices.
In accordance with § 19 UStG (small business regulation), VAT is not charged.
4.2 Shipping costs, where applicable, are displayed separately during checkout.
4.3 Payment is made using the payment methods offered in the online shop, which may include:
PayPal
Credit card (via Stripe)
Apple Pay / Google Pay (via Stripe)
The Seller does not store payment data.
5) Shipment and Delivery Conditions
5.1 Physical goods are shipped to the delivery address provided by the Client during checkout.
5.2 Delivery times are stated on the respective product pages.
5.3 If delivery fails due to reasons attributable to the Client, the Client bears the resulting costs unless a valid withdrawal is exercised.
5.4 Gift cards are delivered digitally by email.
5.5 Event tickets are delivered digitally by email or download.
6) Retention of Title
The goods remain the property of the Seller until full payment has been received.
7) Warranty
7.1 Statutory warranty rights apply.
7.2 For consumers, the warranty period for goods is two years from delivery.
7.3 Minor deviations in color, shape, or texture due to the handmade nature of ceramic products do not constitute defects.
8) Liability
8.1 The Seller is liable without limitation for intent, gross negligence, injury to life, body or health, and mandatory statutory liability.
8.2 In cases of slight negligence, the Seller is liable only for breaches of essential contractual obligations and limited to foreseeable damages typical for the contract.
8.3 Any further liability is excluded.
9) Custom-Made Goods
9.1 Custom-made or personalized goods are produced according to the Client’s specifications.
9.2 Such goods are excluded from the right of withdrawal.
10) Gift Cards
10.1 Gift cards are redeemable exclusively in the Seller’s online shop.
10.2 Gift cards are valid until the end of the third year following the year of purchase.
10.3 Gift cards are not redeemable for cash and do not accrue interest.
11) Event Tickets
11.1 Tickets grant access to the specified event on the stated date, time, and location.
11.2 Tickets are excluded from the right of withdrawal pursuant to § 312g (2) no. 9 BGB.
11.3 In case of event cancellation or rescheduling, the Seller will inform ticket holders promptly. Further claims are excluded unless mandatory statutory liability applies.
12) Applicable Law
12.1 The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods.
12.2 For consumers, this choice of law applies only insofar as mandatory consumer protection provisions of the country of residence are not overridden.
13) Alternative Dispute Resolution
The Seller is neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
